These terms describe how KONG TONG Electronic Limited (“we”, “us”) deals with business customers
(“you”), and what our published standards mean when a transaction is concluded.
Read this first. This website is a catalogue and an enquiry channel. It does not take orders or
payments, and nothing on it is a binding offer. Stock, prices and lead times are confirmed by a person,
in writing, after you contact us. A deal exists only when we have both agreed its terms in writing
(typically over WhatsApp or email) — usually in a quotation, proforma invoice or sales contract.
1. How a deal is made
Every transaction follows the same path, whether it starts from this site or from a message to our team:
- 1. You tell us what you need — models, quantities, grades, destination and timing. A form, an email or a WhatsApp message all work.
- 2. We check the stock and come back in writing — availability, grade, unit price, currency, term and estimated lead time.
- 3. You confirm — by written acceptance of that quotation, or by asking us to issue a proforma invoice.
- 4. Payment and paperwork — as agreed for that specific transaction (see section 4).
- 5. Inspection, packing and dispatch — with the test sheet, photos and serial numbers for each unit.
Written records matter to both sides. Please keep the quotation or proforma invoice you accepted: it is the
document that governs that deal, and it prevails over this page if the two differ.
2. This website is not an offer
- Listings, price indications, model names and stock figures on this site are an invitation to enquire, not an offer capable of acceptance.
- No contract is formed by submitting a form, sending a message, or receiving an automatic reply from this site.
- We do not sell to consumers. By dealing with us you confirm you are buying for resale or for use in your own business.
- We may correct errors on the site at any time, including obvious pricing or specification mistakes, and may decline an enquiry without giving reasons.
3. Quotations
- Quotations are prepared against live stock and the market of the day. Unless stated otherwise they are valid for 3 days; after that we will re-quote.
- Prices are quoted in USD or HKD and, unless stated, exclude freight, insurance, duties and bank charges.
- Tiered pricing (for example −2% at 10+ units, −4% at 50+) applies to one consolidated order, not to separate shipments.
- All stock is offered subject to availability and prior sale. A quotation does not reserve stock unless we say so in writing.
4. Price, payment and currency
Payment arrangements are agreed per transaction and stated on the quotation or proforma invoice. Where no other
arrangement is agreed in writing, our standard terms are:
- T/T — 30% deposit on confirmation, balance before shipment;
- L/C at sight for larger orders, where agreed in advance;
- Bank charges outside Hong Kong are for your account;
- Goods are released once the invoiced amount has cleared in full, in the invoiced currency.
Prices move with the second-hand market. If payment is delayed beyond the agreed date, we may re-confirm the
price and availability before shipping.
5. Grading standard
Every unit is graded against one written standard, on five levels — S (Like New), A (Excellent),
B (Good), C (Fair), D (For parts) — with battery health bands published on our
grading page. That standard is part of what you are buying.
- Each unit ships with a test sheet, photos (front, back, edges, screen on, close-ups of faults) and its serial number.
- Cosmetic wear consistent with the stated grade is not a defect.
- We do not sell refurbished units. “Apple service-pack” means genuine Apple replacement units, which may arrive in plain packaging rather than retail boxes.
6. Inspection and claims
- You are welcome to inspect before shipment at our Kwun Tong hub by appointment, or to ask for photos and test sheets for any lot.
- Report any shortage, wrong model or undisclosed fault within 24 hours of arrival. Later claims are handled at our discretion.
- Anything disclosed on the test sheet is part of the condition you bought and is not grounds for a claim.
- Anything not disclosed, and not caused by accident, liquid, unauthorised repair or misuse, is eligible for return or credit.
- Please keep the packaging, take photos, and wait for a return authorisation before sending anything back.
7. Warranty and returns
- 30 days from delivery against non-accidental faults that were not disclosed.
- 7-day exchange where a unit does not match its grade. We exchange; we do not give cash refunds.
- Excluded: accidental or liquid damage, cracked glass after delivery, unauthorised repair or disassembly, tampered serial numbers, and normal battery wear within the graded band.
- Return freight is on you unless the fault is ours, in which case we cover or credit it.
- Warranty applies to the original buyer and is handled case by case through the contact who sold you the lot.
8. Delivery, title and risk
- The Incoterm is agreed per transaction. Our default is FOB Hong Kong; CIF and DDP are available on request.
- Incoterms® 2020 apply. Title passes on receipt of payment in full; risk passes according to the agreed term.
- Typical dispatch is within 24 hours of cleared payment, with daily air consolidation from Hong Kong and sea freight for pallets.
- We prepare the commercial invoice, packing list, HS codes and certificate of origin. Import licences, duties and local compliance are yours unless we have agreed DDP in writing.
- Transit times quoted by carriers are estimates, not guarantees.
9. When you sell to us
- You confirm that you own the devices, have the right to sell them, and that they are not stolen or subject to any third-party claim.
- We price after inspection. Bulk lots receive a written quotation within 24 hours, valid for 3 days.
- Payment is made once inspection clears. Corporate sellers may be paid by invoice on agreed terms.
- We erase data on intake and can provide erasure or destruction certificates on request. Please back up and sign out of your accounts before handing devices over.
- We may decline devices that are locked, misdescribed, of unknown origin, or that we cannot lawfully export.
10. No payments through this website
We never collect payment on this site, and we never ask for card numbers, one-time codes or online banking
credentials by email, form or social message. Payment is made only to the bank account named on the proforma
invoice issued by us for that transaction.
If you receive a message claiming to be us with different bank details, stop and call
+852 6941 6995 to verify before paying. Bank-detail fraud is common in
this trade, and verifying a change of account is normal practice between trading partners.
11. Liability
Our liability for any claim relating to a lot is limited to the invoice value of the affected units. We are not
liable for loss of profit, loss of business, loss of data or any indirect or consequential loss. Nothing here
limits liability that cannot be limited under Hong Kong law.
12. Compliance
- Both parties will comply with applicable sanctions, export control, anti-money laundering and anti-bribery laws.
- We may ask about the end destination of goods and may refuse a transaction where it cannot be established lawfully.
- You are responsible for the import and telecommunications rules of your own jurisdiction.
13. Intellectual property
Apple, iPhone and related marks belong to Apple Inc. We are an independent reseller of pre-owned and
service-pack devices. We are not affiliated with, endorsed by, or an authorised reseller of Apple, and nothing
on this site should be read as a claim to the contrary.
14. Force majeure
Neither party is liable for delay or failure caused by events beyond reasonable control, including carrier
disruption, customs action, strikes, epidemics, natural events or changes in law.
15. Governing law
These terms and any dispute arising from them are governed by the laws of the Hong Kong Special Administrative
Region, and the courts of Hong Kong have exclusive jurisdiction. A specific contract may provide for
arbitration instead, if both parties agree in writing.
16. Changes
We may update this page from time to time. The version that applies to a transaction is the one in force when
that transaction was confirmed in writing; the terms on a signed quotation or contract prevail over this page.
